A trademark search is not legally required before filing. However, filing without one is a significant practical risk.

A search identifies registered marks that could form the basis of an opposition or an examiner refusal. Without it, you may be investing filing fees and legal costs in an application that faces serious obstacles you could have identified beforehand.
