What are the requirements for registering a logo trademark?

A logo trademark must meet the same two fundamental requirements as any trademark: it must be sufficiently distinctive and must not conflict with any earlier registered mark.

Distinctiveness means the logo must be capable of identifying a single commercial source. Generic shapes, purely descriptive imagery, or logos that are too similar to what others in the same industry use will fail this test. A unique visual identity that consumers would associate with one specific brand is what the registration is designed to protect.

No conflict means the logo must not be confusingly similar to a trademark already registered in the same or a closely related class. A thorough search before filing identifies potential conflicts before they become oppositions.
