
When should I register my trademark?
Timing is everything, and this is especially true when it comes to trademark registration. Choosing to trademark your brand at the right time is much more important than you would think.
You can’t prevent an office action from happening, but you can take some steps before filing to ensure the risk is minimal. Office actions most commonly arise from three sources: descriptiveness or distinctiveness issues with the mark, similarity conflicts with earlier registered marks, and application formalities.
Conducting a trademark search before filing identifies existing marks that could form the basis of a likelihood of confusion refusal. Assessing the mark's distinctiveness before filing identifies whether a descriptiveness objection is likely. Ensuring the application is correctly formatted; accurate goods and services descriptions, the right filing basis, a compliant specimen where required; avoids formality office actions.
None of these eliminate the risk entirely, but a well-prepared application from a mark with clear distinctiveness and no obvious conflicts is significantly less likely to receive an office action than one filed without these checks.
