When should I start with trademark watching?

Generally, it's recommended to start trademark watching right after you file your trademark application. While your mark is undergoing assessment, you are already entitled to certain rights and can, for example, oppose trademark applications filed after yours.

However, trademark watching is an ongoing investment, and it's possible to pay a watch subscription for several months only to have your trademark rejected by the IPO. Some applicants, therefore, choose to wait until their trademark is fully registered to sign up for a service. It certainly is an option if you accept you aren't fully protected during the time between filing and registration.

If you are on the fence, what can help with the decision is a professional assessment of your chances of successful registration. If the risk of rejection is low, you can proceed with trademark watching right away.
