My business name and logo look quite unique, very distinctive from everything out there. Can there still be an issue with my trademark application?

Yes. Distinctiveness relative to your own market research is only one part of the assessment. The IP office examines your mark against all registered and pending trademarks in the relevant class and jurisdiction, which can include marks from industries or markets you may not have encountered.

Over 12 million trademark applications are filed globally each year. A mark that appears unique to you may still be confusingly similar to an earlier registration you were not aware of. A trademark search before filing identifies these conflicts and gives you the opportunity to address them before the application is submitted.
