If I already sell on Amazon, what documents do I have to submit to prove the Use in Commerce requirement for a US trademark?

If you are applying for a US trademark, you have to submit a specimen showing your trademark on the goods that the trademark should protect and that are available to US customers.

For an Amazon store, it's generally sufficient to submit:

  • a screenshot clearly showing the price in USD,
  • the actual weblink, and
  • the date the screenshot was taken.

This is particularly true if you are merely reselling the products and not producing the items yourself. Additional documents can include marketing materials, invoices, and product photos.
