Notice of Opposition

A Notice of Opposition is a formal legal document filed by a third party to challenge the registration of a trademark in a opposition proceeding. The Notice of Opposition must be filed with the relevant trademark office within a specified period of time after the trademark has been published in an official gazette or register, typically 30 to 90 days.

The Notice of Opposition sets out the grounds on which the third party is challenging the registration of the trademark. These grounds may include, for example, that the trademark is too similar to an existing trademark, lacks distinctiveness, is descriptive or generic, or is contrary to public policy or morality. The third party must also provide evidence to support their opposition, such as proof of prior use of a similar trademark or evidence of consumer confusion.
